  1. Definitions, type of cookies and application of regulation 

Cookies are small text files that the websites you visit send and record on your computer or mobile device, and are then retransmitted to these websites the next time you visit. It is thanks to cookies that the website remembers your actions and preferences (such as, for example, login details, language chosen, font size, other display settings, etc.) so that they do not need to be reset when you return to that site or browse from one page to another. 

Therefore, cookies are used to perform computer authentication, session monitoring and storage of information regarding your activities when you access a website. They may also contain a unique identification code that allows to keep track of your browsing experience within the website for statistical or advertising purposes. There are various types of cookies, depending on their characteristics and functions, and they may be stored on your computer for different periods of time: so-called session cookies, which are automatically deleted when the browser is closed; so-called persistent cookies, which remain on your device for a specifically established period of time. 

In accordance with applicable regulation in force, the use of cookies does not always require your consent. Specifically, Technical cookies, i.e. those used for the sole purpose of transmitting a communication over an electronic communications network, or as strictly necessary to provide a service explicitly requested by you, may not require such consent. Among the Technical cookies that do not require express consent for their use, applicable regulations in force in Italy include the following: 

  • First-party analytical cookies, which are used in an aggregated manner to collect information about the number of users and how they visit the website; 
  • Third-party analytical cookies, when tools are adopted that significantly reduce the identification power of cookies by way of data minimization measures, collecting statistical information in aggregate form on the number of users and how they visit the site, and the third party does not combine information collected (even if minimized in the manner described above) through cookies with other sources (such as customer records or statistics concerning visits to other websites) to identify users nor forward such information to other third parties. In other words, in order for analytical cookies to be treated on a par with Technical cookies, it is essential to prevent direct identification – i.e., singling out - of the data subject through their use, which is tantamount to preventing the use of analytics cookies that can work as direct, unique identifiers on account of their features. Accordingly, analytical cookies must be structured in such a way as to enable the same cookie to relate to several devices, which will create reasonable uncertainty as to the IT identity of the cookie recipient. This is usually achieved by masking out appropriate portions of the IP address in the cookie. 
  • Functionality cookies that allow you to browse depending on several selected criteria (e.g. language, products selected for purchase) in order to improve the service provided to you or necessary for authentication and service access. 

However Profiling cookies, i.e. cookies designed to create profiles referring to you and used to send advertising messages in line with the preferences you expressed while surfing the web, require your prior consent. Your consent is also requested for Third-party analytical cookies, when tools are not adopted that reduce the identification power of cookies (not preventing direct identification – i.e., singling out - of the data subject through their use) and the third party cross-checks the information gathered with other information already in its possession. 

 2. Type of cookies used by the Website 

The website uses the following types of cookies: 

  • Technical cookies: this category includes the following types of cookies: 
  • Functionality cookies, i.e. used to enable specific website functions and to configure the website depending on your choices (e.g. language), in order to improve your experience. We inform you that if you disable technical and/or functionality cookies, you may not be able to consult the website, or certain services or specific features of the website may not function properly and you may need to change or manually enter certain information or preferences each time you visit the website. 
  • Analytical cookies, which allow QubicaAMF to understand how the website is used by you and to identify traffic coming in and out of the website. In this respect, we point out that QubicaAMF uses the Google Analytics 4 service or “GA4” (as provided by Google Inc, hereinafter “Google”) according to the following conditions:  
    • GA4 does not log or store individual IP addresses. GA4 does provide coarse geo-location data by deriving the following metadata from IP addresses: City (and the derived latitude, and longitude of the city), Continent, Country, Region, Subcontinent (and ID-based counterparts). For EU-based traffic, IP-address data is used solely for geo-location data derivation before being immediately discarded. It is not logged, accessible, or used for any additional use cases; 
    • in order to further reduce the identifying power of these cookies, QubicaAMF has proceeded, in the GA4 configuration properties, to deactivate the collection of granular location and device data (for further details please refer to this link) as well as to deactivate the Google Signals tool (for further details please refer to this link);  
    • QubicaAMF has accepted the amendment to data protection with Google through which Google undertakes to use these cookies exclusively for providing the service, to store them separately and not to “enhance” or “cross-check” them with other information that is in its possession. On this matter, we inform you that QubicaAMF has not linked GA4 to any additional Google product or services and that no advertising or data sharing options have been set up with Google (turning off all data sharing settings in GA4 configuration properties; for further details please refer to this link).   • Profiling cookies: they record your choices and activity on website to customize our services in a personalized way, conduct advertising to you and offer targeted content in line with the preferences shown during your navigation. 

Regarding Third-party cookies, third parties are typically data controllers that are independent of QubicaAMF for any data gathered through the cookies they use (and the data they gather is used for their own purposes and according to the terms they set). In some cases and for specific activities, these subjects may act jointly with QubicaAMF as joint data controllers. We make every effort to be able to clarify the role played by these subjects in this Cookie Policy or in the Privacy Policy. You can also find Social buttons/widgets, i.e. “buttons” representing social network icons (e.g. Facebook, Twitter, You Tube, etc.), on the website. These “buttons” allow you to visit and interact directly with the social networks with a simple “click”, while you are browsing the website. By clicking on the Social buttons/widgets, the social network acquires the data relating to your visit. Apart from these cases, in which you willingly click to share your browsing data with the chosen social networks, QubicaAMF shall not share any browsing information or data relating to you through its website with social networks accessible through the Social buttons/widgets. The LinkedIn Insight Tag enables the collection of data regarding members’ visits to our website, including the URL, referrer, IP address, device and browser characteristics (User Agent), and timestamp. The IP addresses are truncated or hashed (when used for reaching members across devices), and members’ direct identifiers are removed within seven days in order to make the data pseudonymous.
